UNION NEWS RIDAY MAY 4 1990 Pittsfield lawyer denies complicity By DAVID A VALLETTE PITTSIELD The lawyer for a Pittsfield man charged in con nection with a sexual assault case in Adams said yesterday that au thorities are using the case as an excuse to investigate the disappea rance of Marilyn Roy Bigelow rape case is an excuse to investigate another matter" de clared George Crane the court ap pointed attorney for Kobert Bever ly Beverlv 34 of 60 Lenox Ave pleaded innocent yesterday in Cen tral Berkshire District Court to charges of assault with intent to rape indecent assault and battery on a person who has attained the age of 14 drugging for sexual in tercourse and larceny from a per son in connection with the Adams case During the arraignment Crane said the other matter to which he was referring was the unexplained disappearance of Bigelow who was last seen in the early morning hours of April 14 as one of several passengers in car a green ord which police have con fiscated in a search for clues deny any complicity in ei ther this rape case or any other problem" Crane said Connecticut State Police arrested Beverly early yesterday morning in Waterbury and he was arraigned in Pittsfield later in theday Judge James Scullary set bail at $25000 and scheduled a pre trial conference for Tuesday in North ern Berkshire District Court The charges against Beverly stem from an investigation by Adams police and state police into incidents also occurring on April 14 at a apartment in Adams Police contend that Beverly and another man Clarence Gunn Jr 31 also of 60 Lenox Ave were involved in assaulting and attempting to rape the 33 year old woman Gunn who is a Pittsfield fire fighter pleaded innocent Wednes day to attempted rape and inde cent assault and battery and is being held on $7500 bail He has been suspended from the ire Department until the case is re solved Police said that the woman in the Adams case was plied with drugs and alcohol and was assaulted after she passed out Assistant District Attorney Linda Barry had asked for $50000 bail She said that the crimes Beverly is charged with carry jail terms up to 20 years and that he had fled the state after learning a warrant had been issued for his arrest The warrant was issued in Northern Berkshire District Court on Tues day night Crane said his client should be in rape 1 released in his own recognizance Efforts to find Bigelow have yet to turn up the missing mother of two Along with searches by police relatives and friends have contin ued daily searches of out of the way areas throughout the county 1 During arraignment Crane and Barry differed on whether Beverly was in Connectin cut to escape arrest or not Crane said Beverly had left his Pittsfield home before the warrant was issued
